Timely Filing Denials: Limits, Fixes and Prevention

A timely filing denial means the payer received the claim after its deadline for that date of service. Medicare generally allows 12 months from the date of service; commercial plans set their own limits in your contract, often much shorter.

Why this denial happens

  • The claim sat unbilled because a note was not signed or a charge was never entered.
  • The first submission was rejected by the clearinghouse or payer and nobody noticed or resubmitted it.
  • The claim went to the wrong payer first (for example, the secondary instead of the primary).
  • The practice did not know the contract’s shorter filing limit for a commercial plan.

How to fix a claim that was denied

  1. Find proof the claim was sent on time: the clearinghouse acceptance report or the payer’s acknowledgment with its date.
  2. If you have that proof, send a reconsideration or appeal with it attached; payers usually reverse the denial when the original submission was within the limit.
  3. If the delay came from another payer (for example, waiting on a primary payer’s decision), send that payer’s remittance showing the date it was decided.
  4. If there is no proof and no valid reason, the charge usually has to be written off; the patient generally cannot be billed for your late filing.

How to prevent it

  • Keep a list of every payer’s filing limit and track each open claim against it.
  • Work clearinghouse rejections every day; a rejected claim is not a filed claim.
  • Make unsigned notes and unbilled visits visible daily, so no visit waits weeks for a charge.
  • Confirm the primary payer at check-in so the first claim goes to the right place.

How XEHR’s agents handle timely filing denials

  • Every signed visit becomes a draft claim, so charges are not left unentered.
  • Rejected claims show up in a work queue for your biller to correct and resend.
  • A timely-filing report shows every open claim’s days left against that payer’s own filing limit, riskiest first.

Common questions

What is the timely filing limit for Medicare?

Medicare generally requires claims within 12 months (one calendar year) of the date of service, with limited exceptions set out in 42 CFR 424.44.

Can a timely filing denial be appealed?

Yes, when you can prove the claim was originally submitted within the limit, for example with a clearinghouse acceptance report, or when a recognized exception applies.

Can I bill the patient after a timely filing denial?

Usually not. Contracts with payers generally prohibit billing the patient for a claim denied because the practice filed late.

General information for US practices, not legal advice. Payer rules differ: check your contract and the payer’s provider manual.
